第一章 總 則
第一(yi)條(tiao) 為加強基層工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)經(jing)費(fei)收(shou)支管(guan)理(li)(li),規(gui)范基層工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)經(jing)費(fei)使用(yong),使工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)經(jing)費(fei)更好地惠及廣大會(hui)(hui)(hui)(hui)(hui)員(yuan)職工(gong)(gong)(gong),根據《中(zhong)華人民(min)共和國(guo)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)法(fa)(fa)》和《中(zhong)國(guo)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)章程》《工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)會(hui)(hui)(hui)(hui)(hui)計制度(du)》《工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)預算管(guan)理(li)(li)辦(ban)法(fa)(fa)》《基層工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)經(jing)費(fei)收(shou)支管(guan)理(li)(li)辦(ban)法(fa)(fa)》等有(you)關規(gui)定(ding)以及中(zhong)華全國(guo)總工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)(以下簡稱(cheng)“全國(guo)總工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)”)貫(guan)徹落實(shi)中(zhong)央有(you)關規(gui)定(ding)的(de)相(xiang)關要(yao)求,結合我(wo)省工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)實(shi)際,制定(ding)本實(shi)施細則。
第二條 本(ben)實施細則適用(yong)于企業(ye)、事(shi)業(ye)單位、機關和其他經濟社會組織(zhi)單獨或(huo)聯合建立的基層工會委員會。
第三條 基層工會經費的收(shou)支管理應遵循以(yi)下原則:
(一)遵紀(ji)(ji)守法(fa)原則。基層工會(hui)(hui)(hui)(hui)應依據《中華人(ren)民共和國(guo)(guo)工會(hui)(hui)(hui)(hui)法(fa)》《山(shan)東(dong)省實施<中華人(ren)民共和國(guo)(guo)工會(hui)(hui)(hui)(hui)法(fa)>辦法(fa)》的(de)有(you)關規定,依法(fa)組織各項(xiang)收入,嚴(yan)格(ge)遵守國(guo)(guo)家法(fa)律法(fa)規,嚴(yan)格(ge)執行(xing)全國(guo)(guo)總工會(hui)(hui)(hui)(hui)和山(shan)東(dong)省總工會(hui)(hui)(hui)(hui)有(you)關制度規定,嚴(yan)肅財經紀(ji)(ji)律,嚴(yan)格(ge)工會(hui)(hui)(hui)(hui)經費使用(yong),加強工會(hui)(hui)(hui)(hui)經費收支管理。
(二(er))經(jing)費獨立原(yuan)則。基層工(gong)(gong)會(hui)(hui)應依據全國總工(gong)(gong)會(hui)(hui)關(guan)(guan)于工(gong)(gong)會(hui)(hui)法(fa)人(ren)登記管理的(de)有(you)(you)關(guan)(guan)規定(ding)取得工(gong)(gong)會(hui)(hui)法(fa)人(ren)資格,依法(fa)享有(you)(you)民事(shi)權利、承擔民事(shi)義務,并(bing)根據財(cai)政部、中國人(ren)民銀行(xing)的(de)有(you)(you)關(guan)(guan)規定(ding),設立工(gong)(gong)會(hui)(hui)經(jing)費銀行(xing)賬戶,實行(xing)工(gong)(gong)會(hui)(hui)經(jing)費獨立核算。
(三)預(yu)算(suan)管(guan)理(li)原(yuan)則(ze)。基層工會(hui)(hui)應按照《工會(hui)(hui)預(yu)算(suan)管(guan)理(li)辦法》的(de)要求,將單位各項(xiang)收支(zhi)全部足額納(na)入(ru)預(yu)算(suan)管(guan)理(li)。基層工會(hui)(hui)經(jing)費年度(du)收支(zhi)預(yu)算(suan)(含調整預(yu)算(suan))需經(jing)同(tong)級工會(hui)(hui)委(wei)員會(hui)(hui)和工會(hui)(hui)經(jing)費審(shen)查(cha)委(wei)員會(hui)(hui)審(shen)查(cha)同(tong)意,并報(bao)上級主管(guan)工會(hui)(hui)批(pi)準(zhun)。
(四)服務職(zhi)工(gong)原則。基層(ceng)工(gong)會(hui)(hui)應堅持(chi)工(gong)會(hui)(hui)經(jing)費正確的使用(yong)方向,優化工(gong)會(hui)(hui)經(jing)費支出結構,嚴格控(kong)制一(yi)般性支出,將更多(duo)的工(gong)會(hui)(hui)經(jing)費用(yong)于(yu)為職(zhi)工(gong)服務和開展工(gong)會(hui)(hui)活動(dong),維護職(zhi)工(gong)的合法權益,增強工(gong)會(hui)(hui)組織服務職(zhi)工(gong)的能力(li)。
(五)勤(qin)(qin)儉節約(yue)原則。基層(ceng)工(gong)會應按照黨中央、國務院(yuan)和山東省(sheng)委、省(sheng)政(zheng)府關(guan)于厲行勤(qin)(qin)儉節約(yue)反對奢侈(chi)浪費(fei)(fei)的有關(guan)規定(ding),嚴格控制工(gong)會經(jing)費(fei)(fei)開支(zhi)范圍和開支(zhi)標(biao)準(zhun),經(jing)費(fei)(fei)使用要精打細算,少花(hua)錢多辦(ban)事,節約(yue)開支(zhi),提高工(gong)會經(jing)費(fei)(fei)使用效益。
(六)民主管理原則。基(ji)層工(gong)會應依靠會員(yuan)管好用(yong)好工(gong)會經費(fei)。年度工(gong)會經費(fei)收支情(qing)況應定(ding)期向會員(yuan)大(da)會或會員(yuan)代表大(da)會報告(gao),建立經費(fei)收支信息(xi)公開制度,主動接受會員(yuan)監督。同時,接受上級工(gong)會監督,依法接受國家審計監督。
第二(er)章(zhang) 工會經費收入
第四(si)條 基(ji)層(ceng)工(gong)會經費(fei)收入范(fan)圍包(bao)括(kuo):
(一(yi))會費收入(ru)(ru)(ru)。會費收入(ru)(ru)(ru)是指工(gong)會會員依照全(quan)國總(zong)工(gong)會規(gui)定按本人工(gong)資收入(ru)(ru)(ru)的(de)5‰向所在基層工(gong)會繳納(na)的(de)會費。
(二)撥繳(jiao)經(jing)費(fei)收(shou)入。撥繳(jiao)經(jing)費(fei)收(shou)入是指建立(li)工(gong)會組織的單位(wei)按全部(bu)職(zhi)工(gong)工(gong)資總額(e)2%依(yi)法向工(gong)會撥繳(jiao)的經(jing)費(fei)中的留成部(bu)分。
(三)上級工(gong)會(hui)補助(zhu)收入。上級工(gong)會(hui)補助(zhu)收入是指基層工(gong)會(hui)收到(dao)的上級工(gong)會(hui)撥(bo)付的各類(lei)補助(zhu)款項。
(四)行政(zheng)補助(zhu)收(shou)入。行政(zheng)補助(zhu)收(shou)入是指基層工會(hui)所在(zai)單位依法(fa)對工會(hui)組織給予的各項經(jing)費(fei)補助(zhu)。
(五)事(shi)(shi)業(ye)收(shou)(shou)入(ru)。事(shi)(shi)業(ye)收(shou)(shou)入(ru)是(shi)指基層工(gong)會獨立核算的所屬(shu)事(shi)(shi)業(ye)單位(wei)上繳的收(shou)(shou)入(ru)和非(fei)獨立核算的附屬(shu)事(shi)(shi)業(ye)單位(wei)的各項事(shi)(shi)業(ye)收(shou)(shou)入(ru)。
(六)投(tou)(tou)資收益(yi)。投(tou)(tou)資收益(yi)是指基層(ceng)工(gong)會依據相關規定對外投(tou)(tou)資取得(de)的收益(yi)。
(七)其(qi)他(ta)收(shou)入(ru)。其(qi)他(ta)收(shou)入(ru)是指基層工會取(qu)得(de)的(de)資產盤盈、固定資產處置凈收(shou)入(ru)、接受捐贈收(shou)入(ru)和利息收(shou)入(ru)等。
第五條 基(ji)層工(gong)(gong)(gong)(gong)(gong)會(hui)應加強對各項經費(fei)收入的(de)(de)(de)管理。要按(an)照(zhao)會(hui)員工(gong)(gong)(gong)(gong)(gong)資收入和規定的(de)(de)(de)比例,按(an)時收取全部(bu)會(hui)員應交的(de)(de)(de)會(hui)費(fei)。要嚴(yan)格(ge)按(an)照(zhao)國家統計局公布的(de)(de)(de)職工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資總(zong)額口徑和山東省總(zong)工(gong)(gong)(gong)(gong)(gong)會(hui)規定的(de)(de)(de)分(fen)成比例,及時足額撥(bo)繳工(gong)(gong)(gong)(gong)(gong)會(hui)經費(fei);實行財政(zheng)(zheng)劃撥(bo)或委(wei)托稅務代(dai)收部(bu)分(fen)工(gong)(gong)(gong)(gong)(gong)會(hui)經費(fei)的(de)(de)(de)基(ji)層工(gong)(gong)(gong)(gong)(gong)會(hui),應加強與本單(dan)位行政(zheng)(zheng)的(de)(de)(de)溝通(tong),依法足額落實工(gong)(gong)(gong)(gong)(gong)會(hui)經費(fei)留(liu)成部(bu)分(fen),并及時劃撥(bo)到基(ji)層工(gong)(gong)(gong)(gong)(gong)會(hui)銀行賬戶。要統籌安(an)排行政(zheng)(zheng)補助(zhu)收入,按(an)照(zhao)預算確定的(de)(de)(de)用途開(kai)支,不得將與工(gong)(gong)(gong)(gong)(gong)會(hui)無關(guan)的(de)(de)(de)經費(fei)以(yi)行政(zheng)(zheng)補助(zhu)名義納入賬戶管理。
第三章 工會經(jing)費支出
第六(liu)條 基層(ceng)工會經費主要用于為職工服務和開展工會活(huo)動。
第七條 基層工會經費支出范圍包括:職(zhi)工活動(dong)支出、維權支出、業務支出、資本性(xing)支出、事(shi)業支出和其他支出。
第(di)八條 職工(gong)(gong)(gong)活(huo)動支出(chu)(chu)是指基層(ceng)工(gong)(gong)(gong)會(hui)組(zu)織開展職工(gong)(gong)(gong)教育、文體、宣傳(chuan)等活(huo)動所(suo)發生的支出(chu)(chu)和工(gong)(gong)(gong)會(hui)組(zu)織的職工(gong)(gong)(gong)集體福利支出(chu)(chu)。包括:
(一)職(zhi)工教(jiao)育(yu)支(zhi)出。用(yong)(yong)(yong)于基(ji)層(ceng)工會舉(ju)辦政治(zhi)、法律、科技、業務等(deng)專題(ti)培(pei)訓和職(zhi)工技能培(pei)訓所需的(de)(de)教(jiao)材資(zi)料、教(jiao)學用(yong)(yong)(yong)品、場地(di)租(zu)金等(deng)方面的(de)(de)支(zhi)出,用(yong)(yong)(yong)于支(zhi)付職(zhi)工教(jiao)育(yu)活(huo)動聘請授課人(ren)員(yuan)的(de)(de)酬金,用(yong)(yong)(yong)于基(ji)層(ceng)工會組織的(de)(de)職(zhi)工素質提升補助和職(zhi)工教(jiao)育(yu)培(pei)訓優(you)秀學員(yuan)的(de)(de)獎勵。
對優秀(xiu)學員的(de)獎(jiang)勵應(ying)以精神鼓勵為主、物質激勵為輔(fu),給予物質獎(jiang)勵的(de)每人(ren)(ren)不超過(guo)(guo)500元,獎(jiang)勵人(ren)(ren)數不超過(guo)(guo)參(can)(can)訓人(ren)(ren)數的(de)15%。授課人(ren)(ren)員酬(chou)金標準參(can)(can)照同級(ji)財政部門(men)制定的(de)培(pei)訓費管理辦(ban)法執行(xing)。
(二)文(wen)體活(huo)(huo)動(dong)(dong)支(zhi)(zhi)出(chu)。用于(yu)基層工(gong)會開(kai)展或(huo)參加上(shang)級工(gong)會組織的(de)(de)職工(gong)業余文(wen)體活(huo)(huo)動(dong)(dong)所需(xu)器(qi)材、服裝、用品等(deng)購置、租(zu)賃與維修方面的(de)(de)支(zhi)(zhi)出(chu)以及活(huo)(huo)動(dong)(dong)場地、交通工(gong)具的(de)(de)租(zu)金(jin)支(zhi)(zhi)出(chu)等(deng),用于(yu)文(wen)體活(huo)(huo)動(dong)(dong)優勝(sheng)者(zhe)的(de)(de)獎勵支(zhi)(zhi)出(chu),用于(yu)文(wen)體活(huo)(huo)動(dong)(dong)中必要的(de)(de)伙食補助費(fei)。
文體活動獎勵(li)應以精神鼓勵(li)為主、物質激勵(li)為輔。獎勵(li)范圍不得超(chao)過(guo)(guo)參(can)與人(ren)數的三分之二,團體獎勵(li)人(ren)均(jun)不得超(chao)過(guo)(guo)300元(yuan),個(ge)人(ren)獎勵(li)最高不得超(chao)過(guo)(guo)500元(yuan);不設(she)置獎項(xiang)的,可為參(can)加人(ren)員發放少量紀(ji)念(nian)品(pin),紀(ji)念(nian)品(pin)價值人(ren)均(jun)不超(chao)過(guo)(guo)100元(yuan)。
基層工(gong)會開展文體比賽(sai)活動的,因比賽(sai)活動的特殊需要,可(ke)安(an)排工(gong)作餐,正餐每人(ren)每餐標準不得超過40元。
基層工(gong)會舉辦或參加(jia)上級工(gong)會、行業和系(xi)統組織的文體比(bi)賽活動,根據比(bi)賽項目需要,確有統一著裝要求的,可為參加(jia)人員購買服裝,每(mei)人每(mei)年(nian)不超過800元。
基(ji)層工會在組(zu)織開展(zhan)各類比(bi)賽(sai)時,可(ke)根據(ju)比(bi)賽(sai)項目實際(ji)需要為(wei)參賽(sai)人員購買(mai)人身意(yi)外保險(xian)(xian),購買(mai)險(xian)(xian)種(zhong)根據(ju)實際(ji)情況自(zi)行確定,不(bu)得(de)借此(ci)購買(mai)與比(bi)賽(sai)活(huo)動無關的商業保險(xian)(xian)。
基(ji)層工會可以用會員會費組(zu)織會員觀看電影、文藝演出和體(ti)育比賽等,開展春游秋游,為(wei)會員購(gou)買當(dang)地公園年票。會費不(bu)足部分可以用工會經(jing)費彌補(bu),彌補(bu)部分不(bu)超(chao)過(guo)基(ji)層工會當(dang)年會費收入(ru)的三(san)倍(bei)。
基層工(gong)會組(zu)織會員(yuan)春(chun)游(you)(you)秋(qiu)游(you)(you)應當日往返(fan),不得到有關部門(men)明令禁止的風景名(ming)勝區開(kai)展春(chun)游(you)(you)秋(qiu)游(you)(you)活動。春(chun)游(you)(you)秋(qiu)游(you)(you)確有需(xu)要,可安排工(gong)作餐、開(kai)支(zhi)門(men)票、交通費等,每(mei)人每(mei)天不超過(guo)200元,其中正餐每(mei)人每(mei)餐標準不得超過(guo)40元。
(三)宣傳(chuan)活(huo)動(dong)支出(chu)。用(yong)(yong)于(yu)基層(ceng)工(gong)會(hui)開展重點工(gong)作、重大主題和重大節日宣傳(chuan)活(huo)動(dong)所需的(de)材料消耗、場地(di)租金、購(gou)買(mai)服務(wu)等方面的(de)支出(chu),用(yong)(yong)于(yu)培育和踐行(xing)社會(hui)主義核心價(jia)值(zhi)觀,弘揚(yang)勞模精神(shen)和工(gong)匠精神(shen)等經常性宣傳(chuan)活(huo)動(dong)方面的(de)支出(chu),用(yong)(yong)于(yu)基層(ceng)工(gong)會(hui)開展或參加上級工(gong)會(hui)舉辦的(de)知識競(jing)賽(sai)、宣講(jiang)、演講(jiang)比賽(sai)、展覽等宣傳(chuan)活(huo)動(dong)支出(chu)。
(四)職工(gong)集體(ti)福利(li)支出(chu)。用于基層(ceng)工(gong)會逢年過節和會員生日(ri)、婚喪嫁娶、退休(xiu)離崗的慰問支出(chu)等。
基層工會(hui)逢(feng)年(nian)(nian)過節可(ke)以向全體(ti)會(hui)員發放(fang)節日(ri)慰問品(pin)(pin),每位會(hui)員年(nian)(nian)度總(zong)額(e)不超(chao)過1600元(yuan)。逢(feng)年(nian)(nian)過節的年(nian)(nian)節是指國家(jia)規(gui)定(ding)的法定(ding)節日(ri)(即(ji):元(yuan)旦、春節、清明節、勞動節、端午節、中(zhong)秋節和國慶節)。節日(ri)慰問品(pin)(pin)原則上為符(fu)合中(zhong)國傳統(tong)節日(ri)習慣的用品(pin)(pin)和職工群眾(zhong)必需的生活(huo)用品(pin)(pin)等。基層工會(hui)可(ke)結(jie)合實際采取便捷靈活(huo)的發放(fang)方式,但(dan)不可(ke)發放(fang)現(xian)金、購物(wu)卡等代金券。
工(gong)會(hui)會(hui)員生(sheng)日慰(wei)問可(ke)(ke)以發放不超過300元的生(sheng)日蛋(dan)糕等實物慰(wei)問品,也(ye)可(ke)(ke)以發放指定蛋(dan)糕店的蛋(dan)糕券(quan)。
工會會員(yuan)(yuan)結婚、生(sheng)育(yu)時(shi),可(ke)以分別給(gei)予(yu)不(bu)超過(guo)600元(yuan)的慰問品。工會會員(yuan)(yuan)生(sheng)病住院可(ke)以給(gei)予(yu)不(bu)超過(guo)600元(yuan)的慰問金。工會會員(yuan)(yuan)去世時(shi),可(ke)以給(gei)予(yu)不(bu)超過(guo)2000元(yuan)的慰問金;其直系親屬(限于(yu)配偶、父母(mu)、子(zi)女)去世時(shi),可(ke)以給(gei)予(yu)不(bu)超過(guo)1000元(yuan)的慰問金。
工會(hui)會(hui)員退(tui)休離崗,可以發放(fang)不(bu)超過2000元的紀念品。
(五)其(qi)他活動支(zhi)出。用(yong)于工會(hui)組織開展的勞動模范和先進(jin)職(zhi)工療(liao)休養補貼(tie)等其(qi)他活動支(zhi)出。
第九條(tiao) 維權支出是指基(ji)層工(gong)會用于維護職工(gong)權益的支出。包括:勞(lao)動(dong)關系協調(diao)費(fei)、勞(lao)動(dong)保護費(fei)、法律援助費(fei)、困(kun)難職工(gong)幫扶費(fei)、送溫暖費(fei)和其他維權支出。
(一)勞(lao)動(dong)關(guan)系協調費。用于(yu)推進創建勞(lao)動(dong)關(guan)系和(he)諧企(qi)業(ye)活(huo)動(dong)、加強(qiang)勞(lao)動(dong)爭議調解(jie)和(he)隊伍建設、開展勞(lao)動(dong)合同咨詢(xun)活(huo)動(dong)、集體合同示范(fan)文(wen)本印制與推廣等方(fang)面的(de)支(zhi)出。
(二)勞動(dong)(dong)保護(hu)費。用于基層工會(hui)開展群眾性安(an)全生產和職(zhi)業病防治活動(dong)(dong)、加強群監員隊(dui)伍(wu)建設、開展職(zhi)工心理健(jian)康維護(hu)等促進安(an)全健(jian)康生產、保護(hu)職(zhi)工生命安(an)全為宗旨開展職(zhi)工勞動(dong)(dong)保護(hu)發(fa)生的(de)支出等。
(三)法(fa)律援助費。用于基(ji)層工會向職(zhi)工群眾開展法(fa)治宣(xuan)傳(chuan)、提供法(fa)律咨詢(xun)、法(fa)律服(fu)務等發生的(de)支(zhi)出。
(四)困難(nan)職(zhi)工(gong)幫扶費(fei)。用于基層工(gong)會對困難(nan)職(zhi)工(gong)提供資金和物(wu)質幫助(zhu)等發生的支出(chu)。
工(gong)會(hui)會(hui)員(yuan)本人及家庭因大(da)病(bing)、意外事(shi)故等原因致困(kun)時,基層(ceng)工(gong)會(hui)根(gen)據會(hui)員(yuan)困(kun)難情(qing)況可以一次(ci)性給予不超過(guo)2000元(yuan)的(de)慰問金,由基層(ceng)工(gong)會(hui)結合本單(dan)位實(shi)際,經集體研究公示確認后,公布執行。
基(ji)層工(gong)(gong)(gong)(gong)(gong)會(hui)應按照全國總(zong)工(gong)(gong)(gong)(gong)(gong)會(hui)和山東省總(zong)工(gong)(gong)(gong)(gong)(gong)會(hui)的要求(qiu),建立(li)和完善本單(dan)位工(gong)(gong)(gong)(gong)(gong)會(hui)會(hui)員困難職工(gong)(gong)(gong)(gong)(gong)檔案,建立(li)困難職工(gong)(gong)(gong)(gong)(gong)幫(bang)扶專項資金。具體幫(bang)扶救助標準由各基(ji)層工(gong)(gong)(gong)(gong)(gong)會(hui)根(gen)據實際情況經職代會(hui)通過后確定。
(五)送溫暖費。用于(yu)基層(ceng)工(gong)會開展春送崗位、夏送清(qing)涼(liang)、金秋助學和冬送溫暖等活動發生的(de)支出(chu)。
(六(liu))其他維權支(zhi)出。用于基層工(gong)會補(bu)助職(zhi)工(gong)和會員參加(jia)互助互濟保(bao)障活動等其他方面的維權支(zhi)出。
第十條 業務支出是(shi)指基層工(gong)會培訓工(gong)會干(gan)部、加強自身(shen)建設以(yi)及開展業務工(gong)作發生(sheng)的各項支出。包括(kuo):
(一)培(pei)訓(xun)(xun)費(fei)。用(yong)于基層工會開展工會干部和積極分子培(pei)訓(xun)(xun)發生的(de)支出(chu)。開支范圍和標準(zhun)以同級(ji)財(cai)政部門制定(ding)的(de)培(pei)訓(xun)(xun)費(fei)管理辦法為準(zhun)。
(二(er))會(hui)議費。用于基層工會(hui)會(hui)員大會(hui)或(huo)會(hui)員代表大會(hui)、委(wei)員會(hui)、常(chang)委(wei)會(hui)、經費審(shen)查(cha)委(wei)員會(hui)以(yi)及其他專業工作會(hui)議的(de)各項支出。開(kai)支范圍和標(biao)準以(yi)同級(ji)財政(zheng)部門(men)制定的(de)會(hui)議費管(guan)理辦法為準。
(三(san))專項業(ye)務費(fei)。用(yong)于基層(ceng)(ceng)(ceng)工(gong)(gong)(gong)(gong)會(hui)(hui)開(kai)展(zhan)基層(ceng)(ceng)(ceng)工(gong)(gong)(gong)(gong)會(hui)(hui)組織(zhi)建設、建家(jia)活(huo)動(dong)、勞(lao)模和工(gong)(gong)(gong)(gong)匠人(ren)才創(chuang)新工(gong)(gong)(gong)(gong)作室(shi)、職工(gong)(gong)(gong)(gong)創(chuang)新工(gong)(gong)(gong)(gong)作室(shi)等創(chuang)建活(huo)動(dong)發生的(de)(de)支出(chu)(chu),用(yong)于基層(ceng)(ceng)(ceng)工(gong)(gong)(gong)(gong)會(hui)(hui)開(kai)辦的(de)(de)圖書館、閱覽(lan)室(shi)和職工(gong)(gong)(gong)(gong)書屋等職工(gong)(gong)(gong)(gong)文體活(huo)動(dong)陣地所發生的(de)(de)支出(chu)(chu),用(yong)于基層(ceng)(ceng)(ceng)工(gong)(gong)(gong)(gong)會(hui)(hui)開(kai)展(zhan)專題調研所發生的(de)(de)支出(chu)(chu),用(yong)于基層(ceng)(ceng)(ceng)工(gong)(gong)(gong)(gong)會(hui)(hui)開(kai)展(zhan)女職工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)作性支出(chu)(chu),用(yong)于基層(ceng)(ceng)(ceng)工(gong)(gong)(gong)(gong)會(hui)(hui)開(kai)展(zhan)外事活(huo)動(dong)方面的(de)(de)支出(chu)(chu),用(yong)于基層(ceng)(ceng)(ceng)工(gong)(gong)(gong)(gong)會(hui)(hui)組織(zhi)開(kai)展(zhan)合理化建議、技(ji)術革新、發明創(chuang)造(zao)、崗位練兵、技(ji)術比武、技(ji)術培訓等勞(lao)動(dong)和技(ji)能(neng)競賽(sai)活(huo)動(dong)支出(chu)(chu)及其(qi)獎勵支出(chu)(chu)。
(四)其他業(ye)務支出。用(yong)(yong)于(yu)(yu)基(ji)層(ceng)(ceng)工(gong)(gong)會(hui)發放(fang)兼(jian)(jian)職工(gong)(gong)會(hui)干(gan)部(bu)補(bu)貼(黨政機關、事業(ye)單位、國有企業(ye)編制內的(de)兼(jian)(jian)職工(gong)(gong)會(hui)干(gan)部(bu)不可發放(fang)兼(jian)(jian)職補(bu)貼)和專職社會(hui)化工(gong)(gong)會(hui)工(gong)(gong)作者補(bu)貼。用(yong)(yong)于(yu)(yu)經上級批(pi)準(zhun)評選(xuan)表彰的(de)優秀(xiu)工(gong)(gong)會(hui)干(gan)部(bu)和積(ji)極分(fen)子的(de)獎勵支出,用(yong)(yong)于(yu)(yu)基(ji)層(ceng)(ceng)工(gong)(gong)會(hui)必要的(de)辦公費(fei)(fei)、差旅費(fei)(fei),用(yong)(yong)于(yu)(yu)基(ji)層(ceng)(ceng)工(gong)(gong)會(hui)支付代理記(ji)賬、中介機構審計等購(gou)買服(fu)務方面的(de)支出。
基層工(gong)會經上級(ji)批準可每(mei)(mei)年評(ping)選表(biao)彰(zhang)一次優(you)秀工(gong)會干(gan)部和(he)積極分子,每(mei)(mei)人獎(jiang)金(jin)(或獎(jiang)品)不超(chao)過500元,表(biao)彰(zhang)總人數不得超(chao)過單位會員總數的15%,向(xiang)同級(ji)黨組(zu)織報(bao)備后執行。
第十(shi)一條 資本性支(zhi)出是指(zhi)基層(ceng)工(gong)會(hui)從事工(gong)會(hui)建設工(gong)程、設備(bei)工(gong)具購(gou)置、大型修繕和(he)信息網絡購(gou)建而發生的支(zhi)出。
第十二條(tiao) 事業支出是指基層工(gong)會對獨立核(he)算的(de)(de)附屬(shu)事業單位(wei)的(de)(de)補助和非獨立核(he)算的(de)(de)附屬(shu)事業單位(wei)的(de)(de)各(ge)項支出。
第(di)十三條 其他(ta)支出是指(zhi)基(ji)層(ceng)工會除上述支出以外的(de)其他(ta)各(ge)項支出。包括:資(zi)產(chan)盤虧、固定資(zi)產(chan)處置凈損(sun)失(shi)、捐(juan)贈(zeng)、贊助等。
第十四條 根(gen)據《中華人民共(gong)和國工(gong)會(hui)(hui)(hui)法》的有關規定(ding),基層(ceng)工(gong)會(hui)(hui)(hui)專職工(gong)作人員的工(gong)資、獎勵、補貼由(you)所(suo)(suo)在(zai)單(dan)位承擔(dan);基層(ceng)工(gong)會(hui)(hui)(hui)辦公和開展活(huo)(huo)動(dong)必要(yao)的設施和活(huo)(huo)動(dong)場所(suo)(suo)等(deng)物質條件(jian)由(you)所(suo)(suo)在(zai)單(dan)位提(ti)供。所(suo)(suo)在(zai)單(dan)位保障不足(zu)且基層(ceng)工(gong)會(hui)(hui)(hui)經費(fei)預算足(zu)以(yi)保證(zheng)的前提(ti)下,可以(yi)用工(gong)會(hui)(hui)(hui)經費(fei)適當彌補。
第十五條 基層工會對(dui)個人發放(fang)(fang)獎勵、補助(zhu)、慰問金(jin)、幫扶救助(zhu)款、慰問品、獎品、紀念品、蛋糕券、入場券等(deng)時,應完(wan)善審(shen)批手續(xu),實名(ming)制(zhi)發放(fang)(fang)并(bing)簽收。
第四章 財務管理
第(di)十六條 基(ji)層工(gong)會(hui)主席對基(ji)層工(gong)會(hui)會(hui)計(ji)(ji)工(gong)作和會(hui)計(ji)(ji)資料的真實性(xing)(xing)、完(wan)整(zheng)性(xing)(xing)負責。
第十七條(tiao) 基層(ceng)工會應根據(ju)國家和(he)全國總工會的(de)(de)有關政策(ce)規(gui)定以及(ji)上(shang)級(ji)工會的(de)(de)要求(qiu),制定年(nian)度工會工作計劃,依(yi)法、真實、完整、合理地編(bian)制工會經費年(nian)度預算(suan)(suan),依(yi)法履行(xing)必(bi)要程(cheng)序(xu)(xu)后報上(shang)級(ji)工會批(pi)準。嚴禁無(wu)預算(suan)(suan)、超預算(suan)(suan)使用工會經費。年(nian)度預算(suan)(suan)原(yuan)則上(shang)一(yi)年(nian)調整一(yi)次,調整預算(suan)(suan)的(de)(de)編(bian)制審批(pi)程(cheng)序(xu)(xu)與預算(suan)(suan)編(bian)制審批(pi)程(cheng)序(xu)(xu)一(yi)致。
第(di)十八條(tiao) 基層工(gong)(gong)會(hui)(hui)應根據批(pi)準的年(nian)(nian)度預算,積極組織各(ge)項(xiang)收入,合理(li)安(an)排各(ge)項(xiang)支出,并嚴格按照(zhao)《工(gong)(gong)會(hui)(hui)會(hui)(hui)計制度》的要求,科學設立和登(deng)記會(hui)(hui)計賬簿,準確辦理(li)經費收支核算,定期向(xiang)工(gong)(gong)會(hui)(hui)委員會(hui)(hui)和經費審查(cha)委員會(hui)(hui)報告預算執行(xing)情況。基層工(gong)(gong)會(hui)(hui)經費年(nian)(nian)度財務決(jue)算需報上級工(gong)(gong)會(hui)(hui)審批(pi)。
第十(shi)九條 基層工(gong)(gong)會應(ying)加強財(cai)務(wu)(wu)管理制(zhi)度(du)建(jian)設,健(jian)全完善財(cai)務(wu)(wu)報銷、資產管理、資金使用等內部管理制(zhi)度(du)。基層工(gong)(gong)會應(ying)依法組(zu)織工(gong)(gong)會經(jing)費收入,嚴格控制(zhi)工(gong)(gong)會經(jing)費支出(chu),各項收支實(shi)行(xing)工(gong)(gong)會委員會集(ji)體領導(dao)下的主席負(fu)責制(zhi),重大收支須(xu)集(ji)體研究決定。
第二(er)十(shi)條(tiao)(tiao) 基(ji)層(ceng)(ceng)工(gong)會(hui)(hui)應根據自身實際科學(xue)設(she)(she)置(zhi)會(hui)(hui)計(ji)(ji)機構(gou)、合理(li)(li)配(pei)備會(hui)(hui)計(ji)(ji)人員,真實、完(wan)整、準(zhun)確、及時反映工(gong)會(hui)(hui)經(jing)費收支情(qing)況和(he)財務(wu)管理(li)(li)狀況。具備條(tiao)(tiao)件的(de)基(ji)層(ceng)(ceng)工(gong)會(hui)(hui),應當設(she)(she)置(zhi)會(hui)(hui)計(ji)(ji)機構(gou)或在有關(guan)機構(gou)中設(she)(she)置(zhi)專職(zhi)(zhi)會(hui)(hui)計(ji)(ji)人員;不具備條(tiao)(tiao)件的(de),由設(she)(she)立工(gong)會(hui)(hui)財務(wu)結算中心的(de)鄉鎮(街道)、開發區(qu)(工(gong)業園區(qu))工(gong)會(hui)(hui)實行集(ji)中核算,分戶管理(li)(li),或者委托本(ben)單(dan)位(wei)財務(wu)部門或經(jing)批準(zhun)設(she)(she)立從事會(hui)(hui)計(ji)(ji)代理(li)(li)記賬業務(wu)的(de)中介(jie)機構(gou)或聘(pin)請(qing)兼(jian)職(zhi)(zhi)會(hui)(hui)計(ji)(ji)人員代理(li)(li)記賬。
第五章 監督檢查
第二十一(yi)條 山(shan)東省總工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)負責對全省工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)系統工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)經費的收(shou)入、支出和使用管(guan)理(li)情況(kuang)進行監(jian)督檢查。按照(zhao)“統一(yi)領導、分級(ji)管(guan)理(li)”的管(guan)理(li)體制,設區市級(ji)及以下(xia)各級(ji)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)及經費審查委(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)應加強(qiang)對本(ben)(ben)級(ji)和下(xia)一(yi)級(ji)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)經費收(shou)支與(yu)使用管(guan)理(li)情況(kuang)的監(jian)督檢查,下(xia)一(yi)級(ji)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)應定期向(xiang)本(ben)(ben)級(ji)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)委(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)和上一(yi)級(ji)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)報告(gao)財務監(jian)督檢查情況(kuang)。
第二(er)十(shi)二(er)條 基層工會(hui)應(ying)加強對(dui)本(ben)單(dan)位(wei)工會(hui)經費使用情(qing)(qing)況的(de)內部會(hui)計(ji)(ji)監(jian)(jian)督(du)(du)(du)和(he)工會(hui)預算(suan)執(zhi)行情(qing)(qing)況的(de)審(shen)(shen)查審(shen)(shen)計(ji)(ji)監(jian)(jian)督(du)(du)(du),依法接受并主動(dong)配合國家審(shen)(shen)計(ji)(ji)監(jian)(jian)督(du)(du)(du)。內部會(hui)計(ji)(ji)監(jian)(jian)督(du)(du)(du)主要對(dui)原始(shi)憑證的(de)真實(shi)性(xing)合法性(xing)、會(hui)計(ji)(ji)賬簿與財務報告的(de)準確性(xing)及時性(xing)、財產物資的(de)安全性(xing)完整(zheng)性(xing)進行監(jian)(jian)督(du)(du)(du),以維護財經紀律(lv)的(de)嚴肅性(xing)。審(shen)(shen)查審(shen)(shen)計(ji)(ji)監(jian)(jian)督(du)(du)(du)主要對(dui)單(dan)位(wei)工會(hui)財務收支情(qing)(qing)況和(he)預算(suan)執(zhi)行情(qing)(qing)況進行審(shen)(shen)查監(jian)(jian)督(du)(du)(du)。
第二十三條 基(ji)層工會應(ying)嚴格執(zhi)行以下(xia)規定:
(一)不準用工會經(jing)費請客送禮。
(二(er))不準違反工會經(jing)費使用規定(ding),濫發獎金(jin)、津貼(tie)、補貼(tie)。
(三)不準使用工會經(jing)費從事高消費性娛(yu)樂(le)和健(jian)身(shen)活動。
(四(si))不準單位(wei)行政利用工會賬戶,違規(gui)設立(li)“小金(jin)庫”。
(五)不準將(jiang)工(gong)會(hui)賬戶并入單位(wei)行政賬戶,使(shi)工(gong)會(hui)經費(fei)開支失去控制,
(六)不準截留、挪(nuo)用工會經(jing)費。
(七)不準用(yong)工會(hui)經(jing)費參與非法(fa)集(ji)(ji)資活(huo)動,或為非法(fa)集(ji)(ji)資活(huo)動提供經(jing)濟擔保。
(八(ba))不準(zhun)用(yong)工會經費報銷與工會活動無(wu)關的費用(yong)。
第二十四條 各級工會(hui)對(dui)監督檢查中發現(xian)違(wei)反本辦法的(de)問(wen)題(ti),要(yao)及時糾正(zheng)。違(wei)規問(wen)題(ti)情節較輕的(de),要(yao)限期整改;涉及違(wei)紀(ji)的(de),由紀(ji)檢監察部門依照有關(guan)規定(ding),追究(jiu)直接責任(ren)人(ren)和相(xiang)關(guan)領導責任(ren);構成犯罪的(de),依法移交司法機關(guan)處理。
第六章 附 則
第(di)二(er)十五條 各級(ji)工會應根(gen)據本(ben)(ben)實(shi)施辦法的規(gui)定,結合(he)本(ben)(ben)地區、本(ben)(ben)產業、本(ben)(ben)系統和(he)本(ben)(ben)單(dan)位(wei)工作實(shi)際,細化支出范圍,明確開支標準,規(gui)定審批權限,規(gui)范活動開展。基層(ceng)工會制定的相(xiang)關辦法須報上級(ji)工會備案。
第二(er)十(shi)六條 本辦法自印發之(zhi)日起執行。《關(guan)于貫徹落實全國總工(gong)會加強基層(ceng)工(gong)會經費收(shou)支管理有(you)關(guan)規定的通知(zhi)》(魯會辦〔2015〕10號)同時廢止。
第二十(shi)七條 本辦法由山東省總工會(hui)負(fu)責解釋(shi)。
